So often I Start an initial consultation with a client who doesn’t know what to ask or who has some version of the below questions lined up. These questions should all be answered organically in an initial consultation, but sometimes they’re not and I always appreciate when someone asks me anything on this list of question. Also, it shouldn’t offend anyone that you’re meeting with more than one attorney, you deserve counsel that you feel comfortable with, you will spend a significant amount of time working together.
Cost & Billing
- What’s your hourly rate and how do you bill (increments of 6 minutes, 15 minutes)?
- What’s the retainer amount and when will I need to replenish it?
- Are there additional costs (paralegals, filing fees, copies, court reporters)?
Availability & Communication
- How quickly do you typically respond to calls and emails?
- Will I work directly with you or mostly with paralegals/associates?
- Do you prefer phone, email, or in-person meetings?
- How often will you update me on case progress?
Experience & Approach
- How many divorce cases have you handled similar to mine? Especially important if you’re military, foreign service, World Bank, or other organization with unique pension systems that require a certain level of understanding to negotiate and divide.
- What’s your settlement vs. litigation rate?
- How do you handle high-conflict situations or difficult opposing counsel?
- Are you familiar with local judges and court procedures?
Strategy & Style
- Are you more aggressive or collaborative in your approach?
- How creative are you with settlement solutions (custody arrangements, asset division)?
- Do you support mediation or collaborative divorce when appropriate?
Personal Fit
- Do you listen well and understand my priorities?
- Do I feel comfortable being honest with you about sensitive issues?
- Do you seem empathetic to my situation while staying objective?
- Can you explain legal concepts in plain language?
Practical Matters
- What’s your current caseload – will you have time for my case?
- Who covers if you’re unavailable (vacation, emergency)?
- What do you need from me to work efficiently and keep costs down?
