So often I Start an initial consultation with a client who doesn’t know what to ask or who has some version of the below questions lined up. These questions should all be answered organically in an initial consultation, but sometimes they’re not and I always appreciate when someone asks me anything on this list of question. Also, it shouldn’t offend anyone that you’re meeting with more than one attorney, you deserve counsel that you feel comfortable with, you will spend a significant amount of time working together.
Cost & Billing
- What’s your hourly rate and how do you bill (increments of 6 minutes, 15 minutes)?
- What’s the retainer amount and when will I need to replenish it?
- Are there additional costs (paralegals, filing fees, copies, court reporters)?
Availability & Communication
- How quickly do you typically respond to calls and emails?
- Will I work directly with you or mostly with paralegals/associates?
- Do you prefer phone, email, or in-person meetings?
- How often will you update me on case progress?
Experience & Approach
- How many divorce cases have you handled similar to mine? Especially important if you’re military, foreign service, World Bank, or other organization with unique pension systems that require a certain level of understanding to negotiate and divide.
- What’s your settlement vs. litigation rate?
- How do you handle high-conflict situations or difficult opposing counsel?
- Are you familiar with local judges and court procedures?
